REQUEST THAT THE OTHER PARTY HAVE A PHYSICAL EXAM

A physical or mental exam may be requested in family court for a number of reasons, including: 
  • Divorce:  A spouse may request an independent medical examination (IME) if the other spouse disagrees with their claims about injury, disability, or health. The IME can evaluate the injured spouse’s condition and determine if a valid health condition exists. 
  • Child custody:  A judge may order an evaluation if they need more information to make a decision about a parenting plan. t. 
  • Spousal support:   The court may consider a party’s physical and mental condition when deciding whether to award spousal support. This is because a party’s condition may relate to their ability to work or provide for themselves.
