ASKING FOR A COBI, TI, OR CUSTODY EVALUATION

You can ask the court to appoint a mental health provider in a variety of capacities to assist your family.  Examples include:

A court-ordered behavioral interventionist (COBI) is a professional who works with parents and children to help them develop and maintain healthy relationships. COBI programs are often used in custody cases to help reunite children who are estranged from their parents. 

A therapeutic interventionist (TI) is a mental health professional who is appointed by the court to help families and children resolve problems. TIs can help with a variety of issues, including child estrangement, litigation, relocation of a parent, substance use in one or both parents, and child maltreatment. TIs may consult with the court, attorneys, and families to determine intervention goals. They may also provide psycho-education to families, gather data, and report child maltreatment to law enforcement. 


A child custody evaluation is an investigation of your child’s health, safety, welfare, and best interests by a trained mental health professional (an evaluator). At the end of the investigation, the evaluator will provide a report to you and the judge with a recommendation for a parenting plan in your child’s best interests.

REQUEST AN ATTORNEY FOR THE BEST INTEREST OF THE CHILDREN

The document is a motion requesting the appointment of a Best Interest Attorney (BIA) for minor children in a family law case in the Superior Court of Arizona. The motion is made under Rule 10(a) of the Arizona Rules of Family Law Procedure (A.R.F.L.P.). It outlines the pending case details, including the children’s information, and provides reasons why the case would benefit from a BIA.
 
The BIA would investigate and evaluate events related to the child’s well-being by interviewing the children and other relevant parties. The motion also addresses the financial ability of the parties to pay for the BIA and requests that the court either order the other party to cover the cost or refer the case to the Office of Public Defense if the parties are unable to pay.

MOTION FOR CHILD INTERVIEW

You can ask the court to interview one or all of the children. If you feel your child’s voice should be included in the process, you can use this form to ask the court to set an interview.

REQUEST THAT THE OTHER PARTY HAVE A PHYSICAL EXAM

A physical or mental exam may be requested in family court for a number of reasons, including: 
  • Divorce:  A spouse may request an independent medical examination (IME) if the other spouse disagrees with their claims about injury, disability, or health. The IME can evaluate the injured spouse’s condition and determine if a valid health condition exists. 
     
  • Child custody:  A judge may order an evaluation if they need more information to make a decision about a parenting plan. t. 
     
  • Spousal support:   The court may consider a party’s physical and mental condition when deciding whether to award spousal support. This is because a party’s condition may relate to their ability to work or provide for themselves. 
     

MOTION FOR SAFE HAVEN COUNSELING

 
  • A safe haven counseling process provides a safe space for a child or survivor to discuss their concerns and problems with a counselor who cannot be compelled to testify about the sessions. A court may order safe haven counseling in Arizona to ensure the counselor has doctor-patient privilege and their records cannot be subpoenaed.  Safe Haven counselors may speak to court appointed individuals such as Court Appointed Advisors, Custody Evaluators, etc.r health. The IME can evaluate the injured spouse’s condition and determine if a valid health condition exists.

STIPULATED ORDER FOR A CHILD'S COUSNELING SERVICES

Safe Haven is not always covered under insurance, but the parties can mutually agree to protect the child’s records. This order will facilitate documenting this agreement for the court.

HOW TO ASK THE COURT TO TEST A PARTY FOR DRUG OR ALCOHOL USE

If you believe that the other party is abusing drugs or alcohol, you can ask the court to order various types of testing.  You will need to tell the court:

  • Why you believe substance use is an issue;
  • What type of testing you are requesting; and
  • How the cost of testing will be allocated.
